The following Privacy Policy (the “Privacy Policy”) applies to your use of all websites, mobile applications, and other products and services owned, controlled, operated, or hosted (whether now or in the future) by Forseti, LLC and/or its parents or subsidiaries (collectively referred to herein, solely for ease of reference as “Forseti,” “us,” or “we”), including but not limited to www.forseti.io (the “Website”), and all related applications (e.g., domestic violence, homelessness, field arrest, and animal shelter/foster modules), services, tools, software (e.g., H.A.R.T mobile software platform, analytics platform, referral and alert system, and audit logs) and functionalities (collectively the “Forseti Services”). Forseti Services simplify the process of sharing critical domestic violence, transient, mental health, substance abuse, and pet/animal abuse information with government agencies, victim advocacy groups, and other agencies that are best suited to keep a victim/respondent and/or animal safe.
This Privacy Policy sets forth certain terms and conditions of the legal contract between you and Forseti with respect to your use of the Forseti Services. This Privacy Policy discloses what type of information is collected, the methods used to collect it, and how Forseti utilizes the information to better serve all interested parties and the choices you have about the way your information is collected and used. Please read this Privacy Policy carefully. Your use of the Forseti Services indicates that you have read, accepted, and unconditionally agreed to Forseti’s privacy practices as outlined in this Privacy Policy and any other applicable terms. At Forseti, we respect your right to privacy, and we understand that you need to control the use of your Personal Information (as defined below). This Privacy Policy details below the measures taken by Forseti to protect your privacy in connection with your use of the Forseti Services.
Definitions

Personal Information also includes other information that may be associated with your personal information, such as your Usage Data (defined below), location, preferences, or interests, if that information can be used to identify you, your household, or your device.
⦁ Victim/Survivor Information: Victim/Survivor Information means information that identifies, relates to, describes, or could be reasonably associated or linked with a victim/survivor. Victim/Survivor Information also includes other information that may be associated with victim/survivor information, such as location, preferences, or interests, if that information can be used to identify a victim/survivor or their household.
⦁ Suspect Information: Suspect Information means information that identifies, relates to, describes, or could be reasonably associated or linked with a suspect. Suspect Information also includes other information that may be associated with suspect information, such as location, preferences, or interests, if that information can be used to identify a suspect or their household.
⦁ Usage Data: Usage Data is personalized information about your use of the Forseti Services (e.g., your IP address or the duration of a page visit when you visit the Website) that is collected to understand uses thereof and identify potential improvements.
⦁ Cookies: Cookies are small files stored on your device (e.g., computer or mobile device).
⦁ End User: Any individual who is the subject of the Personal Information collected and/or processed.
Information Collection
We collect information about you and your usage of the Forseti Services in order to fix bugs, improve the Forseti Services, and test and add new features.

⦁ Personal Information: While using the Forseti Services, we may ask you to provide us with, or we may otherwise obtain, certain information that can be used to identify or contact you, such as:

⦁ Usage Data: We may also collect information that your browser sends whenever you access or use the Forseti Services or products such as Forseti’s websites, mobile applications, portals, and other products and services by or through a desktop computer. This Usage Data may include information such as your computer’s Internet Protocol or “IP” address, browser type, browser version, the specific products or services that you access, the time and date of your visit, the time spent using or accessing the products and/or Forseti Services, and unique device identifiers and other diagnostic data. At times, the nature of or combination of various types of data, including Usage Data, may enable you to be identified, and may therefore constitute Personal Information. Similarly, when you access the Forseti Services with a mobile device, Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address associated with your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
⦁ Generic Information: Generic information is information that does not directly reveal the identity of an individual from whom we collect information. This information may include the Usage Data described above and information collected through the use of cookies described below, among others. We may automatically gather Generic Information from our clients, third parties, and visitors of the Website. At times, the combination of various types of data, including Generic information and Usage Data, may enable you to be identified, and may therefore constitute Personal Information.
⦁ Tracking & Cookies Data: We may use cookies and similar tracking technologies to track user activity on the Forseti Services. As described, cookies are files with a small amount of data which may include an anonymous unique identifier and may be sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags, and scripts to collect and track information and to analyze and improve the Forseti Services.
Examples of Cookies we use:
⦁ First Party Cookies. We use session cookies to operate Forseti Services that are accessible through our Website. Session cookies are temporary and are automatically deleted once you close your Internet browser.
⦁ Third Party Cookies. Forseti allows third-party service providers and other companies to use cookies or other similar technologies on the Website. These companies may collect your information, track your behavior on the Website, and gather information about your use of the Website and other online services over time and across different services. For example, we use Google Analytics to anonymously record user activity, demographic information, and general location. With that said, we are not responsible for the functioning of cookies and other technologies used and placed by third parties on your device.

How We Collect Your Information
For the purposes of this Privacy Policy, “Information” means all information disclosed by you to us, including but not limited to Personal Information, Victim/Survivor Information, Suspect Information, Usage Data, Cookies, and other information. Forseti collects and obtains your Information in a few ways: There is information that you choose to give us, information we obtain through your use of Forseti Services (including our Website and mobile application), and information we obtain from third parties (through API, Application Programming Interface, with other software providers).
Information You Give Us
At times, we may require you to provide certain information – including Personal Information – in order to use certain parts of our Website, fulfill your requests to us, or provide you with certain services. For instance, we may require you to provide your name, date of birth, or other identification, contact information, and other relevant information to identify you. We may also ask you to provide your name and relevant identifying information.
Information We Obtain When You Use Forseti Services
As noted above, we collect certain information from you through your use of Forseti Services, such as Usage Data. For instance, in using our Website, we may collect information about the device you use. We may collect IP address and other generic information about how you use our Website or other services (for example, aggregate metrics on how often certain pages on our Website are accessed and viewed).
We also may collect information through the use of cookies or other technologies, as described above.
In other instances, you will need to provide certain information about yourself when using certain services. For instance, when you contact our customer service line we will collect any and all information that you provide to us, including any Personal Information you choose to give to us to verify your identity and rights to access the Forseti Services.
Purposes for Collecting, Processing, and Using Your Information
Forseti collects, processes (or asks our service providers to process on our behalf), and uses your Information to provide the Forseti Services we make available to our Partners/Stakeholders (as defined in How We Disclose of Share Your Information) and you. We therefore will collect and use your Information for a variety of reasons, including:
⦁ To facilitate efficient collection of Victim/Survivor Information and Suspect Information for criminal or social justice interactions (e.g., domestic violence disputes, homelessness encounters, and field arrests).
⦁ To facilitate efficient management of gathering incident information and sharing that information, via established MOUs with our Partners/Stakeholders.
⦁ To facilitate operating our Website and Forseti Services. These operational purposes may include but are not limited to:
⦁ Operating, maintaining, and improving Forseti Services, including the Website;
⦁ Detecting security incidents;
⦁ Helping law enforcement to prosecute individuals responsible for malicious, deceptive, fraudulent, or illegal activity involving Forseti, Forseti Services, and/or our End Users; and
⦁ Assisting with fraud prevention, improving the security of our networks, and reporting suspected criminal activity to law enforcement.
⦁ To comply with applicable laws, in response to a lawful and enforceable request by a law enforcement, judicial, or other public authority, or in connection with an applicable legal obligation.
⦁ For other business or commercial purposes, such as:
⦁ To provide customer support; ⦁ To monitor the usage of the Forseti Services;
⦁ To detect, prevent, and address technical issues; and
⦁ To monitor aggregate usage metrics such as total number of visitors, pages viewed, etc.
How We Disclose or Share Your Information
Memorandums of Understanding: Forseti Services are primarily designed to facilitate efficient management and collection and sharing of Information with various Partners/Stakeholders (as defined below) via established memorandums of understanding, or “MOUs”. Forseti will not disclose the Information to a Partner/Stakeholder unless the Partner/Stakeholder has entered into a MOU with Forseti or the Partner/Stakeholder has entered into an MOU with any other Partner/Stakeholder whom you wish to share Information with and/ or receive information from.
Sale of Personal Information: Forseti does NOT sell your Personal Information to any third party. However, Forseti may disclose or share your Personal Information to certain third parties. For instance, we may share your Personal Information with various third party service providers that facilitate the functions of our Website, such as our web hosting and cloud storage providers. We may also provide your Personal Information or other information you provide us to service providers or contractors to perform functions on our behalf, including assisting us in providing Forseti Services to you or Partners/Stakeholders.
Redacted Information: To the extent Forseti redacts any Information (including without limitation any criminal offender record information (CORI) or any other information Forseti deems confidential) prior to sharing or disclosing the information (hereinafter referred to as “Redacted Information”), Forseti may, in its sole and absolute discretion, for any reason or for no reason, resell, disclose, reproduce, distribute, or otherwise use such Redacted Information in any manner and for any purpose, and to have or permit others to do so.
We may also disclose or share your Information for the following purposes:
⦁ To provide Forseti Services;
⦁ To provide ongoing support;
⦁ To comply with a legal obligation;
⦁ To protect and defend Forseti’s rights or property;
⦁ To prevent or investigate possible wrongdoing in connection with the Forseti Services;
⦁ To protect the personal safety of individuals or the public;
⦁ To protect against legal liability;
⦁ Accounting and other administrative purposes; and
⦁ When there is a good faith belief that such action is necessary to investigate or protect against harmful activities to us or our clients, Partners/Stakeholders, associates, or property (including the Website), or to others. This may include disclosures to law enforcement to investigate potential criminal activity or other civil violations.
We share or otherwise disclose your Information to the following categories of third parties:
⦁ Partners/Stakeholders: Forseti provides your Information to partners/stakeholders including without limitation homeless shelters, substance abuse rehabilitation centers, mental health clinics, domestic violence centers, or pet/animal shelters that are looking to optimize human resource allocation, training, and/or budget allocation.
⦁ Service Providers: We employ third party providers, companies, individuals, and agents to facilitate and help us provide Forseti Services. These service providers perform tasks, services, or functions on our behalf, or assist us in analyzing how Forseti Services are used or delivered. These entities may include payment card processors, cloud-based storage and web-hosting providers, and other entities that assist us in providing the Forseti Services. These providers are granted access to your Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
⦁ Other Forseti Affiliated Entities: We may share or disclose your Information to other entities that make up for the Forseti organization.

Type of Data: Arrest information including, but not limited to, incident no., computer aided dispatch (CAD) no., case no., date/time of arrest, and arrest location information.
Type of Data: Officer information including, but not limited to, name of officer, badge no., unique ID no., and contact information (e.g., email).
Type of Data: Suspect information including, but not limited to, local ID no., global subject no., first name, middle name, last name, alias/moniker, date of birth, ethnic origin, gender, race, and transient status.
Type of Data: Suspect location including, but not limited to, location information, citizenship information, fingerprint information, warrant information, CII no., DL no., FBI no., and additional arrest notes.
Type of Data: Identifying information about a victim including, but not limited to, the victim’s first name, last name, the relationship to his or her abuser, and CAD no.
Data is Disclosed To: Partners/Stakeholders, our service providers, other Forseti Affiliated Entities, and other entities.
Type of Data: Field arrest information about a victim’s abuser (or suspect) including, but not limited to, the suspect’s photograph, name, alias, date of birth, ethnicity, gender, race, transient status, home address, and immigration status.
Type of Data: Domestic violence assessment information including, but not limited to, relationship status between victim and abuser, employment status of abuser, and other information such as history of violence record, whether the abuser may have access to deadly weapons, and whether the abuser has violent, jealous, controlling, or suicidal tendencies.
Type of Data: Animal/pet shelter/foster information including, but not limited to, number and types of animals in household, information about ownership, responsibility, and decision making for the animals/pets, and additional notes about the animals/pets.
Type of Data: Cookies or Usage Data (to the extent that they can identify you).
Type of Data: Other information that you choose to provide to us that can identify you.
Type of Data: Any other information that may identify you.
Categories of Personal Information Disclosed
Forseti may disclose the categories of Information as defined above to our service providers for our business and commercial purposes.
Categories of Personal Information Sold
Forseti does NOT sell individuals’ Personal Information except when such information is part of a merger, acquisition, or other transaction involving all or part of our business. If we sell all or part of our business, make a sale or transfer of assets, or are otherwise involved in a merger or other business transaction, we may transfer your Personal Information to a third party as part of that transaction. If such transaction materially affects the manner in which your Personal Information is processed, we will notify you of such change prior to its implementation.
Our Policy on “Do Not Track” Signals under the California Online Protection Act (CalOPPA)
We do not support Do Not Track. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable “Do Not Track” by visiting the “Preferences” or “Settings” page of your web browser. Forseti may track your online behavior over time and across web services. Forseti’s tracking of behavior for our Website includes only anonymous information about the usage of the Website. This tracking is currently supported through the Google Analytics services (https://analytics.google.com/).
Third parties may collect data that relates to you. We cannot control third parties’ responses to do-not-track signals or other such mechanisms. Third parties’ use of data relating to you and responsiveness to do-not-track signals is governed by their respective privacy policies.
Your Data Protection & Privacy Rights
California residents: Forseti has in place policies and procedures to facilitate your exercise of privacy rights available under applicable law. Forseti therefore informs you that, where applicable under relevant law, you may be entitled to the following:
⦁ Right to Access / Disclosure: to have access to your Personal Information upon simple request – that is, you may receive a copy of such information upon receipt of a verifiable request, along with other information related to the collection or processing.
⦁ Right to Information About Collecting, Selling, Sharing, or Disclosing Personal Information: upon receipt of a verifiable request, you may obtain a list of:
⦁ The specific pieces of your Personal Information Forseti holds;
⦁ The categories of Personal Information collected about you or disclosed to third parties for business purposes;
⦁ The categories of sources from which Personal Information is collected; and
⦁ The categories of third parties with whom Personal Information is shared or disclosed for a business purpose.
⦁ Right to Deletion / “Right to be Forgotten”: to obtain the deletion of your Personal Information in the situations set forth by applicable data protection law and upon receipt of a verifiable request.
⦁ Right to Non-Discrimination. As defined under relevant law, you have a right to non-discrimination in the Forseti Services or quality of Forseti Services you receive from us for exercising your rights.
Please contact us using the means listed in the “Contact Us” Section in relation to exercising these rights. Note that we may ask you to verify your identity – such as by requiring you to provide information about yourself – before responding to such requests.
Your California Privacy Rights Regarding Direct Marketing Information
Forseti does not share individuals’ Personal Information for direct marketing purposes.
Under California law, you have the right to send us a request at the designated address listed below in the “Contact Us” section to receive the following information:
⦁ the categories of information we disclosed to third parties during the immediately preceding calendar year; and
⦁ the names and addresses of the third parties that received the information.
To make such a request, please provide sufficient information for us to determine if this section applies to you and attest to the fact that you are a California resident. Please also provide a current California address for our response. You may make this request in writing to us at the below address. Any such request must include “California Privacy Rights Information Request” in the first line of the description, and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the address provided for this purpose below. Also, note that responsive information may be provided in a standardized format that is not specific to you.

Please note that this Privacy Policy does not govern the practices of third parties, including our service providers, Partners/Stakeholders, affiliates, or advertisers that use our customized offerings, even when those services are branded as, or provided on behalf of, Forseti. Third-Party Sites: Forseti Services may contain links to third-party sites or applications. Unless expressly otherwise stated by Forseti, Forseti is not responsible for the privacy policies and/or practices of linked third-party sites or applications. When you leave the Forseti Services and go to a third-party site or application, our Privacy Policy will no longer apply, and any information collected from or about you on the third-party site or application will be governed by the privacy policy of that third party. Third-party sites’ or applications’ privacy policies and data practices may be substantially different from those of Forseti. They may send their own cookies, web beacons, etc. to your computer or mobile device and may collect data about you and make use of the data in ways that we would not. Prior to using any third-party functionalities on or in connection with the Forseti Services, you should consult the privacy notices of the third-party providers of such functionalities. Once again, we have no control over what information is collected by such third parties or how they may use the information. The privacy policies and data practices of such third parties may significantly differ from ours, and we make no representation or warranty whatsoever about their data policies and practices. Your communications and interactions with such third parties are solely between you and them and are at your own risk.
Children’s Privacy
All of Forseti Services, including our Website, are intended for adult users, and are not meant to address or be used by anyone under the age of 18 (“Children”). As such, Children under 18 may not use our Website or any other Forseti Services. If you are under 18, do not attempt to register for or use any of our Forseti Services, including our Website, and do not provide us any Personal Information about yourself.
We do not knowingly collect Personal Information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has violated this Privacy Policy and provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children without verification of parental consent, we will take steps to remove that information from our servers.
Changes to This Privacy Policy
We may update our Privacy Policy from time to time. While we reserve the right to make changes to our Privacy Policy at any time and at our sole discretion, we will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via a prominent notice on our Website prior to any material changes becoming effective and will update the “effective date” at the top of this Privacy Policy. Submitting a Verifiable Request Regarding Exercise of Your Rights under the California Consumer Privacy Act
As mentioned above, California residents have certain rights to access, delete, or otherwise exercise rights regarding their Personal Information under the California Consumer Privacy Act of 2018 (“CCPA”). Forseti will respond to an individual’s “verifiable request” to exercise his or her rights under the CCPA – that is, where Forseti has received a request purporting to be from a particular individual, and Forseti has been able to verify the individual’s identity. The need to verify an individual’s identity is critical to protecting your information, and to ensuring that your information is not shared with anyone pretending to be you or someone who is not authorized to act on your behalf.
You may submit a verifiable request via our request webform and our toll-free number, listed in the “Contact Us” section below. Forseti will ask you to provide information about yourself so that we can verify your identity as part of this process. This information may include your name, your address, information related to your case, and any other information deemed necessary by Forseti to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you. Once we have your submission, we will compare the information you provided to the information we have about you to verify your identity. Once we have verified your identity, we will work to fulfill your request in a timely manner. Please note there may be some situations in which we are unable to fulfill your request, such as if we cannot find any information about you within our systems. Additionally, we may not be able to honor a deletion request in some situations, such as if your information is necessary to your relationship with us or to meet a legal obligation. We will inform you whether we can fulfill your rights request.
We may ask for additional information if we have difficulty confirming your identity. We will not share your information or honor other requests in those situations where we are unable to confirm that a request for your information is a “verifiable request.” We will not be able to process your request if we cannot verify your identity.
Under California law a California resident can appoint an “authorized agent” to make certain verifiable requests upon their behalf, such as the right to know what information we collect about the End User or to request deletion of the End User’s information. An authorized agent may submit a request by following the steps outlined above. An authorized agent must identify the End User he or she is submitting a request on behalf of, and provide the information requested by Forseti to verify the End User’s identity. Forseti will also require the purported authorized agent to submit proof that he or she has been authorized by the End User to act on the End User’s behalf.
Because the security and privacy of your information is paramount, we will ask that you identify and provide permission in writing for such persons to act as your authorized agent and exercise your applicable rights under California law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization. We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.
